1. Introduction

Welcome to XR 3D Services. These Terms and Conditions govern your use of our services, which include but are not limited to traditional marketing, design, development, and extended reality (XR) solutions. By engaging with our services, you agree to these terms.

2. Services Provided

  • Design & Development: We offer graphic, interactive design, video web development, and other traditional solutions tailored to your marketing needs.
  • Extended Reality (XR) & 3D Services: Our XR & 3D services cover Virtual Reality (VR), Augmented Reality (AR), Mixed Reality (MR) and traditional gaming, providing immersive experiences for marketing, training, and entertainment purposes.

3. Acceptance of Terms

  • By engaging with XR 3D Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

4. Intellectual Property

  • All content, designs, XR & 3D experiences, and software developed by XR 3D Services remain our intellectual property until ownership is formally transferred.
  • You grant us a non-exclusive license to use your logos, trademarks, and content for the purpose of providing services.

5. Payment and Invoicing

  • Services are billed according to the agreed-upon contract or project scope. Payment terms will be outlined in our contracts.
  • Late payments may incur additional fees as per agreement.

6. Confidentiality

  • Both parties agree to maintain confidentiality regarding proprietary information shared during the course of business.

7. Use of Services

  • Services are for lawful purposes only. Illegal activities or content will result in immediate termination of services.

8. Limitation of Liability

  • XR 3D Services will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services.

9. Termination and Refund Policy

Termination by Either Party: Either party may terminate this agreement with written notice.

Return, Refund, and Cancellation:

  • Right to Cancel: You have the right to cancel your service within 14 days from the date of purchase without giving any reason. To exercise this right, you must inform us of your decision via email at [Your Contact Email].
  • Refund Process: Upon cancellation, we will process a refund for the full amount paid, excluding any transaction fees or costs incurred for data transmission, unless otherwise stated. Refunds will be made using the same method originally used for payment unless expressly agreed otherwise.
  • Exceptions: Services or products tailored specifically for you are non-returnable due to their bespoke nature. Once access to digital products or services is granted, they are non-refundable due to immediate digital delivery and use.
  • Post-14 Day Cancellations: After the initial 14-day period, cancellations may still be accepted at our discretion but are subject to charges for work completed up to the cancellation request.
  • Faulty Services or Products: In the case of services or products not meeting the agreed specifications or being defective, please notify us immediately. We will endeavor to rectify the issue. If rectification is not possible or satisfactory, a refund or replacement may be offered at our discretion.

Costs Upon Termination: Upon termination by either party for convenience (i.e., not for breach or default), the client will be liable for all costs incurred up to the date of termination, including but not limited to design, development, and any specialized XR or 3D work completed.

Payment Upon Termination: Payment for work completed up to the date of termination must be made in full upon delivery of the work, unless otherwise agreed upon in writing.

10. Data Privacy

  • We will handle your data in accordance with privacy laws. For any services, we ensure data security and privacy in compliance with global standards.

11. Amendments

  • XR 3D Services reserves the right to update these terms. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

  • These terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

13. Dispute Resolution

  • Any dispute arising from or relating to these terms shall be resolved through mediation or arbitration before resorting to legal action.
